Terms of Service
This is a courtesy translation. In the event of any discrepancy, the Spanish version prevails.
1. Acceptance of the terms
By accessing and using SmoothOperator, you agree to be bound by these Terms of Service. If you do not agree with any part of them, you must not use the service.
2. Description of the service
SmoothOperator is an AI race engineer platform for sim racing. It provides telemetry analysis, real-time voice assistance and, in the versions of the application that include it, an optional live dashboard for sharing your session, all for supported racing simulators.
3. Account and licence
Your licence is tied to the account you sign in with and is for personal use only and non-transferable. You must not share, resell or assign your licence key. You are responsible for keeping your account secure. Using the desktop application requires signing in with the same account in order to activate your plan automatically.
4. Plans, limits and acceptable use
We offer three paid plans (Rookie, Pro and Creator), as well as a free mode and a “Power User” mode in which you provide your own API key. Each paid plan includes a monthly allowance of AI units — each action deducts the units it costs, so the cap is the same however you spread your usage. Once it is used up, the AI is paused until the next period; the rest of the application (telemetry, HUD and offline alerts) keeps working. The current figures for each plan are published on the pricing page. These limits exist to ensure fair use and the sustainability of the service.
The Starter and Endurance plans are no longer sold. They remain in force for those who subscribed to them before they were withdrawn, with the price and limits they had at the time, and renew as normal while the subscription remains active. If you cancel or switch to another plan, it will not be possible to subscribe to them again.
The service is intended for personal use within the context of sim racing. It is prohibited to use it for unlawful purposes, to circumvent the usage limits, or in a way that infringes the rights of third parties.
5. Subscriptions, payments and non-payment
Plans are billed in advance according to the chosen cycle (monthly or annual) through Stripe, and renew automatically until you cancel them. You can cancel or change plan at any time from your account; access continues until the end of the period already paid. If a renewal payment fails, your subscription moves to a non-payment status and paid features may be suspended until it is settled. Except where required by law, no refunds are given for partial periods.
6. Live sharing
The live dashboard lets you broadcast your telemetry in real time via a link. It was available up to version 1.2.4 of the application and is available again from version 1.3, which requires you to be signed in with your account; it comes switched off and you switch it on yourself. Anyone with that link can watch your session while it is active. You are responsible for whom you share the link with; you can rotate the token to invalidate previous links at any time from your account.
7. Limitation of liability
SmoothOperator is provided “as is”. We do not guarantee uninterrupted availability or that the analysis and advice generated by AI are accurate at all times. The information is offered for guidance within sim racing and its use is the sole responsibility of the user.
8. Changes to the terms
We reserve the right to update these terms at any time. Significant changes will be communicated by in-app notification or by email.
9. Affiliate programme
The affiliate programme of Giro Merino S.L. is for content creators (YouTubers and streamers). The creator earns 25% of what each customer they bring pays, excluding VAT, during that customer’s first 12 months. If they have 25 or more active paying customers, they move up to 35% for as long as that is maintained. Their audience gets a 20% discount in the first year with their code or link.
The link is smoothoperator.tech/?ref=CODE. It is remembered for 60 days and the last link counts. The code can also be entered at checkout.
Commissions are settled every month by bank transfer, against an invoice, from €50. Each commission waits 30 days before being paid, in case of refunds. If a payment is refunded, its commission is deducted. While in the programme, the creator receives the Creator plan free of charge.
It is prohibited to run paid ads that bid on the “SmoothOperator” brand, to buy using the creator’s own code, and to promise features that the game does not provide. For example, in GT7 the game does not publish off-track excursions, rivals or flags, so it cannot be claimed that the engineer warns about those in GT7. We may remove a creator from the programme if they breach these conditions.
